On January 27, 2017 the President of the Supreme Court of the Slovak Republic, Ms. Daniela Švecová, has attended the Judicial Seminar at the invitation of the President of the European Court of Human Rights („European Court“), Mr. Guido Raimondi. The topic of the seminar was the Non-refoulement as a principle of international law and the role of the judiciary in its implementation. The event took place at the premises of the European Court.
The opening address of Mr. Guido Raimondi and Ms. Ganna Yudkivska, judge of the European Court representing Ukraine, was followed by the introductory session. Mr. François Crépeau, UN Special Rapporteur on Human Rights of Migrants and Mr. Ledi Bianku, judge of the European Court representing Albania, were discussing fundamental case law of the European Court reflecting common principles relating to the seminar’s topic. After the introductory session there were two parallel workshops prepared for the participants of the seminar. One of them was entitled “Assessment of the credibility of asylum-seekers: burden of proof and the limits of the ECHR’s examination” and the other one “Reception of migrants: material and procedural guarantees for settled migrants”. The delegation from the Supreme Court of the Slovak Republic has attended the first of the mentioned workshops. Ms. Michèle de Segonzac, President of the French National Asylum Tribunal and Mr. Georges Ravarani, judge of the European Court representing Luxembourg, were the speakers at the workshop. The working session of the seminar was concluded by the speeches on current migrations problems presented by Mr. Bruno Nascimbene, former professor of EU law at the University of Milan and Mr. Carlo Ranzoni, judge of the European Court representing Liechtenstein.
The seminar participants were also acquainted with the project of the “Superior Courts Network” launched by the European Court in October 2015. The network forms an information platform primarily designed for the exchange of information between the superior courts and the European Court regarding the Convention case law and related questions.
The judicial year at the European Court was opened by the solemn hearing at the presence of not only the seminar participants, but also all the judges of the European Court. Mr. Guido Raimondi and Ms. Silvia Alejandra Fernánder de Gurmendi, the President of the International Criminal Court, delivered their speeches at the ceremonial opening.
